1. What Personal Data We Collect And Why We Collect It

Kognifi cares about your privacy.  Privacy protection is an important aspect of Kognifi.  For this reason, we collect and use personal information as follows, only as needed to deliver our products, services, websites and mobile applications, and to communicate with you about the same, or as you have requested (collectively, our “Services”).

  • Date of birth
  • Email address
  • Billing and payment information
  • Other data collected that could directly or indirectly identify you.

2. Basic Account Information

When you submit forms in which you give us contact information (such as your name, address, phone numbers, billing information, IP address and email address) so that you can create an account, place orders, register domains, request information, and request support help.  As you use your account, we may also collect support requests and other related types of information that is specific to the management of your account and Services with us.  This also enables us to send legally required communications to you on your orders and products purchased.

This type of information is legally and/or contractually required to be able to purchase and use Services.  For example, we are required to be able to verify this type of information upon request by our payment processor.  It is also required to be able to serve legal notices to you and is mandated by certain Services we offer.  In addition, some Services, such as domains, require this information for you to purchase them.  

If you are purchasing a domain from us, we are required by law to collect and retain this information.  We are further required to verify that the information provided is accurate and serve legally required notices regarding your domain(s).  Consent for the collection, use and retention of this information for these purposes is considered to be contractually given for the duration of your use of such Service and any legally required retention period. 

Like any other online service provider, when we are compelled by law, in the good faith belief that such action is necessary in order to comply with the law, or when we must comply with a legal process.  Examples of these are court orders, subpoenas and other legal processes.

4. Identity Verification, Fraud and Malicious Activity Prevention

The data collected is also used to verify your legal identify and prevent fraud, spam, hacking or cybercrime on our platforms, with authoritative service providers such as government agencies and security service providers.

5. Comments

When visitors leave comments on the site, we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it.  The Gravatar service privacy policy is available here: https://automattic.com/privacy/.  After approval of your comment, your profile picture is visible to the public in the context of your comment.

6. Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included.   Visitors to the website can download and extract any location data from images on the website.

7. Testimonials

We may post customer testimonials on our website which may contain personally identifiable information.  These maybe from third party websites such as reviews on search engines, social media, reviews sites or from our own reviews platform.

8.  Analytics

We use information gathered about you from our site statistics via log files provided by third-party tracking partners (for example, your IP address) to help diagnose problems with our server and to administer our website.  We also gather broad demographic information from this data to help us improve our site and make your browsing and purchasing experiences more enjoyable.

9. Public Blog

Our websites may offer a publicly accessible blog.  You should be aware that any information, such as comments, likes, images, actions on the site and feedback you provide in this area may be read, collected and used by others who access it.

10. Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies.  These are for your convenience so that you do not have to fill in your details again when you leave another comment.  These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies.  This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices.  Login cookies last for two days, and screen options cookies last for a year.  If you select “Remember Me”, your login will persist for at least two weeks.  If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser.  This cookie includes no personal data and simply indicates the post ID of the article you just edited.  It expires after 1 day.

11. Embedded Content From Other Websites

Articles on this site may include embedded content (e.g., videos, images, articles, etc.).  Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

12. Data Processing and Transfers

When you use or interact with any of our Services, you consent to the data processing, sharing, transferring and uses of your information as outlined in this Privacy Policy.  Regardless of the country where you reside, you acknowledge that you are directly transferring your data to us to our cloud platforms, where the servers could be anywhere in the world depending on our backend service providers that enable some of our Services.  Our service providers are based in the United States, United Kingdom, India, Malaysia and Singapore and maybe using servers based there or elsewhere.  You acknowledge and agree to your data processing within the United States, United Kingdom, India, Singapore and Malaysia, where Kognifi processes its data with its service providers located there.

In addition, you authorize us to transfer, process, store and use your information in countries other than your own in accordance with this Privacy Policy and to provide you with Services.  Some of these countries may not have the same data protection safeguards as the country where you reside.  By using our Services, you consent to us transferring information about you to these countries.

13. How Long We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely.  This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile.  All users can see, edit, or delete their personal information at any time (except they cannot change their username).  Website administrators can also see and edit that information.

14. What Rights You Have Over Your Data

If you have an account on this site, or have left approved or published comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us.  You can also request that we erase any personal data we hold about you.  This does not include any data we are obliged to keep for administrative, legal, or security purposes.

15. Your Contact Information

We use emails to communicate with you, to confirm your placed orders, to send information that you have requested and to serve legally or contractually required communications.  Legally required emails cover ICANN mandated verification emails, renewal notices and any other policy or procedure created by ICANN which governs the purchase of domains.  Additionally, we may be required by law to serve notices to you such as DMCA Takedown Notices, UDRP notices, etc.  Or we may deem a change to one of our policies to be material and, therefore, determine a duty (though not a legal requirement) to inform you of this change.  These types of communications do not fall under any of our opt-out procedures.

16. Changes

We may update this Privacy Policy from time to time, so you should check it periodically.  If we make changes that are in our opinion material, we will provide you with appropriate notice of such changes.
